Please take the time to review and understand the Booking Conditions outlined below prior to booking your trip. It also advisable that you read thoroughly the Total Travel Itinerary relating to your trip before booking, so as to ensure that you fully understand the requirements outlined in the package for the trip that you are selecting and it’s accompanying agenda.
Bookings are made by Touch the Road, LLC (us/we). Once you have booked a trip with us, you are considered to have read and agreed to the terms and conditions outlined in this Booking Policy. This establishes the entire agreement between you and TTR, as such your booking will be accepted based on this agreement. Your confirmation invoice is furnished with the services that are to be provided.
2. Dates and itinerary Info
The dates, prices and your itinerary are valid from 01 January to 31 December 2016. Beyond these outlined dates, itineraries and prices are indicative only.
3. Deposits Info
All clients are required to pay a non-‐refundable fee of USD$150 for your booking to be processed and confirmed. The $150 deposit is built into the total cost of your trip. Trips lasting longer than ‘6 days’ will require a larger deposit. If your booking is made within 25 days of departure then the full amount is required upon booking.
You will receive emailed confirmation of your booking once processing has been completed. Your booking confirmation invoice will contain information regarding final payments. Payment on the balance of your Trip’s Package is due 25 days before the departure date. If the balance is not paid on or before the due date, we reserve the right to treat your booking as cancelled. Also, you may be required to contribute to a susu but this is dependent on the TTR package that you have selected.
5. The Susu
Travellers are required to contribute to a susu depending on the package purchased. This is an on the ground payment which will be placed in a central fund and is overseen by the TTR guide as well as the travellers. It can be used to fund certain excursions, meals, snacks and some activities. You will find additional information on the Susu in your Trip Notes. Susu amounts are subject to change so kindly check our website for any changes at least 48 hours prior to the start of your trip.
6. Your Kit: Total Travel Itinerary
You are required to review and complete all necessary paperwork (Medical and Emergency Contact Release, Safety Policy, Health Insurance, travel insurance that you purchased, Release from Liability and Image Release) that will furnish the TTR team with relevant information about you and/or your group.
(A) Please provide us with necessary details such as full name in passport, date of birth, nationality, passport number, passport issue and expiry date by completing the Contact Form attached to this Booking Policy. You booking will not be completed without provision of these details.
7. Last Minute Bookings
A late fee may be applicable due to additional costs that may result from last minute adjustments.
8. Cancellation On Your Part
Should you cancel some or all parts of your trip, cancellation fees will be applicable. A cancellation will be accepted once written confirmation is received.
(A) Note the following:
- TTR reserves the right to retain the deposit paid if cancellation occurs 60 days prior to departure
- TTR reserves the right to retain the deposit or 50% of the total booking costs whichever amount ismore if cancellation occurs between 59 and 25 days and
- TTR reserves the right to retain 100% of monies paid by you in connection with the booking shouldcancellation occur 25 days prior to departurePlease note that lenient cancellation conditions may be applied to shorter trips (3 days or less). Speak with your booking agent for further details. Should you decide to leave the trip for any reason after it has commenced, TTR is not obliged to offer refunds for any unused services.
9. Cancellation By TTR
TTR maintains that all tours will proceed as scheduled except in circumstances inclusive of natural disasters, civil unrest and/or any kind of serious national emergency that will affect the safety of our staff and travellers. In these instances, bulletins will be placed on our website on the Safety page as well as our Home page and emailed also to confirmed travellers. cancellation may also occur with due notice of at least 26 days prior to departure subject to clause V. In instances where tours are cancelled, we recommend that you transfer amounts paid to an alternate departure date. You may also receive a full refund. Please note that the refund will not include monies paid for processing which is non-‐refundable.
10. Amendments To Your Booking
If you and/or your group decide to transfer from one package to another, please notify us at least 25 days prior to the proposed date of departure. Changes to your package or choice of package will result in a fee of USD$75 per person as well as additional fees that may be levied by hotels, ground operators and so on. If you notify us of your intent to transfer less than 60 days prior to departure, the refund policy applicable to cancellations will apply. Amendments made to other arrangements made in conjunction with your trip will incur an USD$50 administration fee per booking per change. Amendments to your booking are not permitted within 10 days of departure.
11. Age Considerations
TTR welcomes travellers inclusive of children and the elderly. Travellers with toddlers and seniors over the age of 70 may not be eligible for packages that include physically demanding/strenuous activities. We ask that travellers take into consideration the package that they select and the ability of their group to undertake same. Additionally, children under the age of 18 must be accompanied by an adult who is responsible for their well-being.
12. The Right Paperwork
Possession of the correct visas, permits and certificates for your trip is your responsibility. All travellers are expected to carry a valid passport. Travellers need to ensure that they have the required visa(s) to allow for travel prior to departure. Also, please ensure that you have the required permits and certificates for countries that you may visit during your trip. TTR is not responsible for anyone who is denied entry to a country because you lack the correct passport, visa or other relevant travel documentation. Please be sure to travel with a copy of your return flight home, you will be unable to enter Jamaica without proof of departure.
The itineraries provided for each trip is indicative of types of activities that you may want to consider. That said, some amount of flexibility may result as routes, schedules, itineraries and mode of transportation may be altered without prior notice due to local circumstances and events.
14. Our Guides
TTR has selected a professional and efficient team to guide our travellers. All travellers are expected to abide by the rules outlined within our Safety Policy as well as those given by their group’s guide while participating in TTR scheduled activities. The decision of the guide is final on all matters regarding their personal safety and that of each individual within the group.
It is our aim to maintain the itineraries that we offer. However, TTR reserves the right to make changes/amendments to all itineraries. In cases where changes are made, travellers will be contacted. Travellers are advised to also check our website prior to departure for recent updates or changes. While changes may be made prior to departure, there are others that may be made after departure. TTR reserves the right to change the itinerary after departure due to any local circumstances or events out of our control. Please note that we are not responsible for any expenses that you or your group may incur as a result of the change of itinerary such as non-‐refundable flights, visas or vaccinations.
16. Acknowledgement Of Risk
All travellers must review all information regarding their personal safety as well as the descriptions of activities outlined in the Safety Policy and Itineraries respectively. Upon signing the Safety Policy, each traveller agrees to accept responsibility for his/her personal safety. Due to the physically demanding nature of some of TTR’s trips/activities, we advise that travellers be honest about health issues and aware of the environment into which they will be going by taking the initiative to do research prior to booking.
17. Limitation of Liability
Due to the nature of our business, we contract with a network of companies inclusive of government agencies and individuals. These businesses are considered as third parties and as such TTR can not be held liable for acts and omissions by these third parties.
(A) To the fullest extent permissible by law:
- Any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip or any breach of the Booking Policy, is excluded;
- TTR (staff, agents and representatives) is released from liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip; and
- Any condition or warranty which would otherwise be implied by law into these Booking Policies (Implied Warranty), is excluded. Implied Warranty: this cannot be excluded, our liability in respect of this is limited to (in our absolute discretion): (1) the provision of a trip similar to the equivalent value; or (2) a refund of the total amount received by us in connection to your booking. Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.
TTR offers additional activities that travellers may select. These Add-‐Ons are not included in the price for your trip. Note that TTR is not accountable for activities that are selected outside your booked TTR package with the exception of TTR Add-‐On activities.
19. Feedback, Claims and Suggestions
TTR values the concerns of our travellers. It is our hope to provide impeccable service, however there may be some instances in which challenges may occur. We would love to hear from you. Please forward your suggestions to ashley[at]touchtheroad[dot]com. If you have a complaint about your trip, please speak with your guide immediately. Should you feel that the matter was not handled in a satisfactory manner please email ashley[at]touchtheroad[dot]com and submit your complaint in writing within 30 days of the end of your tour.
20. Photos Release And More
Travellers are required to sign the TTR Image Usage Policy upon arrival. This release grants us permission to use your image for the promotional and marketing purposes of Touch The Road, LLC. Whilst you retain copyright of your submitted images, this agreement gives us perpetual, royalty-‐free, worldwide, irrevocable license to use your image.
We understand the importance of privacy and protecting one’s image. Any personal information collected about you will explicitly be used mainly for the purpose of your trip with us. Relevant information may be disclosed to our guides, service providers or other suppliers who enable us to operate the trip.
